Equipment Purchasing

Pixelwerx functions only as a contracted purchasing agent for its clients, and does not engage in retail sales.  Payment for hardware and software due upon order. Remaining balance is due upon completion of project. Shipping charges will be based on the client’s preferred method of shipping. Client is responsible for actual shipping charges. Client is responsible for payment of applicable taxes to the appropriate agency. Product prices are based on current market rates. Pixelwerx reserves the right to withdraw any submitted proposal in the event of market volatility that affects pricing.

Network Testing

Conditions: Network testing and evaluation services represent a “best effort” to identify network performance deficiencies and anomalies specific to the network and the devices attached to the network. It is possible that not all network performance issues will be identified or resolved. Additionally, modifications to the network that occur subsequent to testing, may negatively impact network performance. Modifications that can impact network performance include, but are not limited to, changes to the network infrastructure, network hardware, computer hardware, printers, peripherals, and software. As such, no warranty is expressed or implied.

Recurring Payments

Payments for recurring services (web hosting, hosted services, domain registration) are due on or before the due date indicated on your invoice. Accounts which remain unpaid after the due date will be suspended. Accounts which remain unpaid for thirty days will be terminated without notice.  Fees for domains and web hosting are non-refundable. Domain name registrations which remain unpaid for seven or more days past their renewal date may incur an $80 Redemption Fee from the domain registrar in addition to the domain registration fee.  The redemption fee is collected by the registrar and cannot be waived.

Cancellation of Services

Web and mail hosting services must be canceled in writing no later than the due date of the next invoice. We are unable to prorate hosting fees, and hosting fees are non-refundable. Please note that once canceled, hosting services will remain active through the current paid service term and will be terminated immediately following the due date specified on the next invoice. Files, databases, and email stored on hosting servers will no longer be accessible after an account is terminated.

Data Retention

(web hosting, hosted services, domain registration) Web pages, files, databases, DNS records, and other data stored on our hosting servers may, at our discretion, be retained in a compressed backup file for up to thirty days after the termination date (sixty days after due date). Under most circumstances, backup files can be used to restore web services if the customer’s account is paid in full before the backup files are permanently removed. We are unable to restore web services after the backup files have been permanently removed. There is a $25.00 fee for restoring files from backup.

Email Services

Due to the potential legal liability of spam messages being relayed through our servers by spammers, malware, viruses, and worms, we do not offer support for outgoing mail services.  Outgoing mail services (SMTP) should be provided by your Internet service provider.

90 Day No Crash Guarantee for Server Installations

Applies only to onsite server installations with initial operating system configuration performed by Pixelwerx.  Servers with operating systems configured by third parties do not qualify for this guarantee.In the event of a server crash, Pixelwerx will provide free onsite technical support and service, or remote technical support and service where applicable, for 90 days from the date of installation.Onsite and remote service is available from 8:00 AM to 5:00 PM next business day or same day best effort (subject to availability).

Terms: A server crash is defined as an unexpected server shutdown or loss of function resulting from hardware failure or operating system error. Server must be protected by an uninterruptible power supply at all times. Server crashes caused by power failure, UPS failure, or automated UPS shutdown, do not constitute a server crash.Server shutdowns performed in the course of hardware installation, software installation, or routine maintenance, do not constitute a server crash.Server crashes resulting from, but not limited to, the following acts or conditions are not covered by this guarantee: Physical damage to the server and its components, deletion or damage to critical files and data resulting from negligence or mischief, damage from electronic viruses or worms, vandalism, sabotage, electrical damage resulting from an unprotected power supply, failure to perform necessary maintenance (i.e. critical patches and service packs), modifications to the hardware or software configuration of the server, or installation of hardware or software that results in a crash or loss of function. Server must be protected by an uninterruptible power supply at all times.
